1. Acceptance of Product Terms
The DIGI HOOF TESTER product is intended to be used as a diagnostic tool to test for pain response in horses, cows or other hoofed animals. By pre-ordering, purchasing, registering or using the DIGI HOOF TESTER product (the "Product") in either its standard and/or adjustable version, you agree to be bound by these Terms and Conditions of Use ("Product Terms"). If you do not agree to all of these Product Terms, do not use the Product.
2. Professional Expertise
The Product should only be used by individuals with experience and knowledge in using hoof testers in general, such as farriers, veterinarians, hoof trimmers, or caretakers with requisite experience with hoof testers. The Product should be used with caution and care to avoid any injury to the horse, cow, other hoofed animal or the user.
3. Intended Use
The Product is intended for use in testing the sensitivity of an animal’s hoof. Any other use is not recommended and is at your own risk. The Product should be used to apply focal pressure to specific areas of an animal’s hoof to test for a pain response, usually indicated by the horse, cow or other hoofed animal by a withdrawal of the limb, as understood by individuals with experience and knowledge in using hoof testers in general, such as farriers, veterinarians, hoof trimmers, or caretakers with requisite experience with hoof testers.
4. Instructions Manual
Always follow the instructions manual provided with the Product. The Product should be used in accordance with the instructions manual provided by Step Analysis LLC or its affiliates as part of the Product.
5. Safety
Always use the Product in a safe manner. Do not use it in a way that could harm you, the animal, or others. The Product should be used in a correct and safe manner, as there is an incorrect and dangerous way to use it just as with any hoof tester in general. The Product should not be used to cause unnecessary discomfort or harm to the horse, cow or other hoofed animal as understood by individuals with experience and knowledge in using hoof testers in general, such as farriers, veterinarians, hoof trimmers, or caretakers with requisite experience with hoof testers.
6. Storage
The Product should be stored in a safe and secure location when not in use. A storage case is supplied by Step Analysis LLC or its affiliates as part of the Product for this purpose of safe and secure storage of the Product while not in use.
7. Warranty
The Product comes with a lifetime warranty. The warranty does not cover defects or damage arising from improper use or maintenance, normal wear and tear, abuse, accident or external causes. Please refer to the Product’s warranty for further details and remember to register your product once you receive it to activate the warranty. It is your responsibility to inspect the Product for any defects or damage and to request repair or replacement if any defect damage is detected.
8. Limitation of Liability
In no event will Step Analysis LLC or its affiliates be liable for any injury or damage caused by the use, misuse, or inability to use the Product.
(a) You expressly understand and agree that Step Analysis LLC, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Step Analysis LLC or its affiliates have been advised of the possibility of such damages), resulting from your use or inability to use the Product.
(b) To the extent permitted by law, Step Analysis LLC’s or its affiliates’ liability for any claim arising out of or in connection with the Product or these Product Terms, whether in contract, tort, or otherwise, shall be limited to the amount paid, if any, by you to Step Analysis LLC or its affiliates for use of the Product.
9. Changes to Product Terms
Step Analysis LLC or its affiliates reserve the right to revise these Product Terms at any time. It is your responsibility to review these Product Terms periodically. By continuing to use the Product after any such revisions become effective, you agree to be bound by the revised Product Terms.
10. Governing Law
These Product Terms shall be governed by and construed in accordance with the laws of State of Maryland, United States of America, excluding that body of law pertaining to conflict of laws. Any legal action or proceeding arising under these Product Terms will be brought exclusively in the federal or state courts located in Maryland and you hereby irrevocably consent to the personal jurisdiction and venue therein.
